TERMS OF SERVICE

The QCS (Quirk Craft Studio) Terms of Service lay out the agreement between the graphic design company and its customers. This document defines what QCS offers and outlines the responsibilities of those using the service. Topics include intellectual property rights, ending the agreement, liability, dispute resolution, and payment. By using QCS services, customers agree to these terms.

Definitions - In this agreement, the terms "QCS," "Quirk Craft Studio," "our," "we," "us," and "I" refer to the graphic design studio known as QCS, operated by Jeffrey McQuirk. "User," "you," and "your" refer to the person or entity using our services. "Service" refers to the graphic design services provided by QCS.

  • Scope of Service - QCS provides professional design services. By using these services, you agree to be bound by these terms and conditions.

  • Payment - Payment is generally required before work begins. I will provide an invoice, which must be settled before the project can commence, unless I decide to allow trusted clients to pay after project completion.

  • Graphic Design - I strive to deliver high-quality design services tailored to your needs. You are entitled to one major graphical revision at my discretion and unlimited minor revisions (spelling, grammar, or small adjustments) to ensure satisfaction. Revisions must be submitted within five business days of receiving the initial draft. I will respond and begin making the requested changes within two business days.

  • Email Correspondence - QCS will respond to emails within two business days. I value prompt communication and will make every effort to reply quickly to inquiries.

  • User Responsibilities - The user is responsible for providing clear and accurate information to QCS and for ensuring that the use of our services complies with all applicable laws and regulations. You agree not to use our services for any illegal or unethical purpose, and do not submit any content that is harmful, threatening, abusive, or otherwise violates the rights of others.

  • Intellectual Property - All designs and other intellectual property created by QCS remain my property until full payment is received. Once payment is complete, ownership of the deliverables transfers to you. You grant QCS a non-exclusive, transferable, royalty-free license to use any content you provide for the purpose of delivering services. I may also use completed work in social media posts, marketing, and portfolio displays without restriction.

  • Termination - I reserve the right to terminate services at any time, with or without cause, and with or without notice. In the event of termination, you will no longer have access to the services, and any designs created by QCS will remain the property of QCS.

  • Unresponsive Clients - You agree to maintain regular communication during the project. If you fail to respond to any communication from me for 30 continuous days, I reserve the right to terminate the contract without further notice. Reactivating a project after termination may require a reactivation fee of up to 20% of the original project cost.

  • File Storage - QCS retains project files for a limited period after completion unless otherwise requested for ongoing projects. Clients are solely responsible for backing up and storing their own files. QCS is not liable for lost or missing client files.

  • Refund Policy - Below are the outlined guidelines for a refund policy that is designed to be fair to both the client and Quirk Craft Studio.

    • Refunds may be provided if the agency fails to meet the agreed-upon scope of work or deliverables. This means that if the agency fails to deliver what was promised, the client should be entitled to a full or partial refund.

    • Refunds will not be provided if the client changes their mind or decides they no longer want the services of QCS. 

    • Refunds will be based on a percentage of the work completed. If QC has completed a portion of the work, they are entitled to retain a percentage of the fee based on the amount of work completed.

    • Refunds will not include any expenses incurred by QCS that were directly related to the project. This includes costs such as software licenses, stock photography, or other materials that were purchased specifically for the project.

    • If a refund is requested, QCS will review the circumstances and work with the client to find a resolution that is satisfactory to both parties. Refunds will be issued promptly once the terms of the refund have been agreed upon.

  • Deposit Policy - Our payment processing policy is designed to be fair and transparent for both the client and QCS. I believe that this approach helps ensure our clients receive the best possible services and that I can operate my business efficiently and effectively.

    • At QCS, a minimum deposit of $150.00 is required before work begins on any project. This deposit is non-refundable, meaning if the client cancels the project or decides not to proceed, the deposit will not be returned. The deposit will be applied toward the total cost of the project.

    • Once the deposit is received, I will begin gathering all necessary information and resources to complete the project. Full payment for the project is required before rendering the final deliverables. This ensures both the client and QCS are fully committed and allows me to provide high-quality design services.

    • Payment instructions and options will be provided to clients during the project onboarding process. QCS reserves the right to waive the deposit for preferred or returning clients at my discretion.

  • Disclaimers - QCS provides the services "as is" and does not make any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. QCS does not guarantee that the services will be uninterrupted or error-free, and will not be liable for any damages resulting from the use of the services.

  • Indemnification - You agree to indemnify and hold QCS harmless from any and all claims, damages, expenses, and costs arising from your use of the services or your violation of these terms and conditions.

  • Governing Law - These terms and conditions will be governed by and construed in accordance with the laws of the Tarrant County Judicial District without giving effect to any choice or conflict of law provisions.

  • Changes to Terms of Service - I may update these terms at any time. Continued use of my services constitutes acceptance of the revised terms.

  • Dispute Resolution - Any disputes arising from these terms and conditions or the use of the services will be resolved through binding arbitration in accordance with the rules of the Tarrant County Judicial District.

These Terms of Service are effective as of September 26, 2025.
